ONLINE BOUTIQUE RULES

I. Introductory provisions

  1. These Regulations define the terms and conditions of sale in the Online Store under the name sklep-madelle operating through the website available on the Internet at www.sklep-madelle.pl (hereinafter referred to as the "Online Store"), operated by Madelle Magdalena Magnon with its registered office in Połaniec, address: Ul.Krakowska Mała 15, 28-230 Połaniec, NIP 866-166-40-43 (hereinafter referred to as the "Seller").
  2. These Regulations ("Regulations") are addressed to all users of the Online Store - they define the rules for registering and using the Online Store account, the rules for making electronic reservations of products available in the Online Store's offer, placing orders in the Online Store and the rules for concluding Sales Agreements.
  3. Each user placing an order (hereinafter referred to as the "Customer") in the Online Store is obliged to read and comply with the provisions of the Regulations.
  4. These Regulations are available on the Online Store website in a form that allows you to download, save and print a version of them on a medium of your choice.
  5. The personal data controller is Madelle Magdalena Magnon, ul. Krakowska Mała 15, 28-230 Połaniec.

II. General provisions

  1. The Seller sells goods in the form of clothing and accessories (hereinafter referred to as "Goods").
  2. Information about products in the Online Store, including descriptions and prices, constitutes an invitation to submit an offer to conclude a sales contract within the meaning of Article 71 of the Civil Code, in accordance with the terms of the Regulations.
  3. Goods in the Online Store are clearly marked. The website provides information about the product's characteristics, price, and materials.
  4. The Seller exercises due diligence to ensure that the presented photos of the Goods offered are accurate and reflect their actual condition. Any slight color differences that may occur between the online presentation and the original appearance are due to technical reasons, and the Seller is not responsible for them. If you have any questions regarding the online presentation of the Goods, please contact the Seller by email or phone.

III. Rules for using the Madelle Online Store

  1. The Madelle online store enables you to purchase goods offered by the online store via an electronic network.
  2. In order to use the Online Store, the Customer must have an active email account. A Customer who does not have an active email account will not be entitled to pursue claims for inability to access the Online Store.
  3. The sales agreement is concluded between the user of the Online Store ("Customer") and Madelle Magdalena Magnon with its registered office in Połaniec.
  4. The recording, protection, and disclosure of material provisions of distance contracts are accomplished by printing and providing the Customer with proof of purchase (receipt or VAT invoice) or a specification of the purchased products along with the delivery of the products. The Act of 2 March 2000 on the Protection of Certain Consumer Rights and on Liability for Damage Caused by a Dangerous Product applies to distance contracts.
  5. The online store takes all possible technical and organizational measures to prevent unauthorized persons from obtaining and modifying the data provided during registration.
  6. The User who has used the Online Store is obliged to:

– Not providing or transmitting content prohibited by law;
– Use the Online Store in a way that does not disrupt its operation;
– Not sending or posting unsolicited commercial information within the Online Store;
– Use the Online Store in a way that is not burdensome for other Customers and the Administrator of this store;
– Use the content posted on the Online Store website for personal use;
– Use the Online Store in a manner consistent with the provisions in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.

IV. Conclusion of the sales contract

  1. To conclude a sales contract, you must place an order on the Online Store website.
  2. The online store accepts online orders 24 hours a day, seven days a week. Orders placed on non-business days will be processed on the first business day following the day on which the order was placed.
  3. The Customer may place an order without having to permanently register his/her data in the Online Store database (so-called purchases without registration).
  4. To place an order, the Customer must read and accept the provisions of these Terms and Conditions and consent to the processing of their personal data provided during the order process for the purpose of fulfilling and processing the order placed in the Online Store. This consent is voluntary, but necessary to place the order.
  5. The condition for placing an order is to complete all required data for shipment in the form available on the Online Store website and to generate proof of purchase in the system in the form of a receipt or VAT invoice.
  6. To place an order, you must select products from the available offer of the Online Store, their colors, sizes and quantity by "adding" them to the cart.
  7. Sending the order by the Customer (confirming it with the “Place an order” button) constitutes the Customer’s offer to Madelle Magdalena Magnon with its registered office in Połaniec to conclude a Sales Agreement, in accordance with the Regulations.
  8. After the Customer places an order, they will receive a message on the Online Store's website and via email containing information about the items in the order, the quantity of products, the order value, the selected delivery and payment method, and the Customer's contact information. This message confirms the Online Store's receipt of the Customer's purchase offer.
  9. The Customer receives confirmation of acceptance of their offer electronically ("Order Acceptance Confirmation") to the email address they provided. Upon receipt of this confirmation, a sales contract for the goods ordered by the Customer is concluded.
  10. The place of conclusion of the Sales Agreement is the registered office of the Seller.
  11. The sales contract is concluded in Polish, with the content consistent with these Regulations.
  12. The Customer may make changes to the order up until the time the ordered Goods are shipped. Changes may include canceling all or part of the Goods included in the order, changing the delivery address, or changing the invoice information. In the event of a change to the order, the Customer should immediately contact the Online Store by phone or email. In the event of cancellation of the order, if payment was made in advance, the refund will be made within fourteen (14) days of receiving the Customer's cancellation.
  13. If, after confirming the acceptance of the Customer's order, its execution proves impossible for reasons other than the lack of Goods in the Online Store, including when the purchase of Goods from the Seller's suppliers is not possible within the time allowed for the execution of the order, the Seller will inform the Customer by e-mail or telephone about the circumstances that have arisen.
  14. If the ordered Goods are unavailable or the ordered Goods are unavailable and the Customer's order cannot be fulfilled, the Seller has the right to cancel the order within twenty-one (21) days from the date of the order. If the Customer has paid for the Goods, the Seller will refund the Customer within seven (7) days of the order cancellation date.
  15. The commencement of order processing may be contingent upon telephone verification of the order placed by the Customer.
  16. The online store reserves the right to refuse to process an order under a sales contract if the Customer's contact details are false, the transaction has not been authorized in the electronic payment system or payment for the order has not been made within the specified time, as well as in the case of orders placed by persons who:

– do not comply with the provisions of these regulations;
– previously placed orders and then withdrew them without giving any reason;
– previously refused to receive the ordered goods without justifiable reason;
– have abused or are clearly attempting to abuse the Seller’s trust.

V. Delivery and Pick-up

  1. Orders are delivered via courier or Poczta Polska to the address indicated in the order by the Customer, depending on the place of delivery and payment method.
  2. The Seller begins processing the order immediately after the Customer places the order. If the Customer chooses electronic payment, processing the order will begin upon receipt of the payment. The Goods will then be shipped after the Seller receives confirmation of the Customer's successful payment.
  3. The total and maximum order fulfillment period should not exceed fourteen (14) business days and in no case thirty (30) days from the date of conclusion of the sales contract.
  4. The Seller shall not be liable for non-delivery of the Goods or delay in delivery caused by an incorrect or inaccurate address provided by the Customer.
  5. The Seller attaches proof of purchase to each shipped Goods in the form of a receipt or VAT invoice.
  6. Upon receipt of a parcel delivered by courier, the Customer should carefully inspect the package for completeness, the condition of the external packaging, and the ordered goods in the presence of the forwarder. In the event of damage to the parcel, the Customer should complete a damage report with the courier, in two identical copies signed by the Recipient and the courier.

VI. Prices and payment methods

  1. Information about the purchase price of goods in the Online Store is provided on its website. These prices are binding at the time the Customer places an order.
  2. All prices listed on the Online Store website are gross prices in Polish zloty.
  3. The product prices quoted do not include delivery costs.
  4. The shipping costs of the purchased Goods are borne by the Customer in the amount of:
    Domestic shipping cost – PLN 15;
    Shipping cost to EU countries – PLN 70;
    Shipping costs to non-EU countries are determined individually. Shipping costs are determined individually depending on the destination country and the weight of the shipment.
  5. The Customer may choose the following methods of payment for the ordered Goods and for the delivery of the ordered Goods:
    – by transfer to the Seller's bank account
  6. In the case of payment made via a payment service, positive transaction authorization is a condition for completing the order.
  7. If you choose to pay by bank transfer to the Seller's account, your order will be processed once the funds have been deposited into the Seller's bank account. Please include your order number in the transfer description.
  8. The date of payment is deemed to be the date on which the Seller's bank account is debited.

VII. Complaints

  1. Pursuant to the Act of 27 July 2002 on specific terms and conditions of consumer sales and amending the Civil Code (Journal of Laws of 2002, No. 141, item 1176, as amended), the Seller is liable to a Customer who is a consumer within the meaning of Art. 221 of the Civil Code for any non-conformity of the Goods purchased by that consumer with the Sales Agreement. In the case of Customers who are not consumers, the Seller is liable under the principles specified in the Civil Code.
  2. Complaints should be submitted via email to madelle@madelle.pl, and the Goods in question should be delivered to the Seller at the following address: Madelle Magdalena Skiba, ul. Jana Kazimierza 28/164, 01-248 Warsaw, with the note: "Madelle Complaint." A properly submitted complaint should include the Customer's details (including their first name, last name, postal address, and email address) and a description of the problem giving rise to the complaint. Complaints that do not contain the above-mentioned information will not be considered by the Seller.
  3. Complaints regarding defects in purchased goods should be reported to the Seller no later than two (2) days from the date of receipt of the shipment.
  4. The Seller will review the complaint within fourteen (14) business days of receiving the shipment containing the complained Goods. Information on the complaint resolution process will be provided to the Customer via email to the Customer's email address or by telephone.
  5. If the Seller does not take a position on the complaint submitted by the Buyer within fourteen (14) business days from the date of receipt of the goods complained about by the Seller, it is assumed that the complaint has been deemed justified by the Seller.
  6. The Seller is not liable for any damage resulting from improper use of the offered products.
  7. Slight color differences between the online presentation and the original are due to technical reasons and cannot be the subject of a complaint.
  8. Damage to the shipment during transport will only be taken into account on the basis of a report made to the courier company employee or Poczta Polska at the time of delivery.
  9. If the complaint is accepted, the Seller will send the Customer a full-fledged product (repaired or new), and if this proves impossible, the Seller will offer the Customer another Product as a substitute for the defective Product or will refund the full amount of the price paid for the Product.
  10. If the complaint is not accepted, the goods will be returned together with an opinion as to the invalidity of the complaint.

VIII. Right to withdraw from the Sales Agreement

  1. Pursuant to the Act of 2 March 2000 on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Journal of Laws No. 22, item 271, as amended), the Customer has the right to return purchased products within 14 days of the date of receipt, while retaining the invoice (receipt or VAT invoice).
  2. Returned goods must not show any signs of use. They must be complete and have their tags attached. If the goods are returned in accordance with the terms and conditions, the Seller will refund the purchase price within seven (7) business days to the bank account specified by the Customer.
  3. Products made to individual order (tailor-made) are not subject to exchange or return.
  4. The cost of returning the Goods to the Seller is borne by the Customer. The Seller does not accept any cash-on-delivery shipments.

IX. Copyright

  1. All items in the Online Store at www.sklep-madelle.pl were designed by Magdalena Magnon and are protected under the Copyright Act.
  2. The Seller owns all copyrights to the content contained on the Online Store's website and is subject to legal protection.

X. Personal data security policy:

  1. In accordance with the Personal Data Protection Act of 29 August 1997 (and subsequent amendments), we ensure the protection of all personal data obtained as a result of conducting commercial activities and fulfilling your orders on our website.
  2. The Seller ensures that Customers' personal data will be processed solely for the purposes of order fulfillment and for the Seller's marketing purposes.
  3. In cases and under the terms specified in the Personal Data Protection Act of 29 August 1997 (Journal of Laws of 2002, No. 101, item 926, as amended), the Customer has the right to request the supplementation, updating, or correction of personal data, the temporary or permanent suspension of their processing, or their deletion if they are incomplete, outdated, untrue, have been collected in violation of the law, or are no longer necessary to achieve the purpose for which they were collected, and also has the right to submit a written request to cease the processing of their personal data.
  4. The Seller will not process or make available to other entities data about Customers and purchases made by Customers.

XI. Others

  1. These Regulations constitute an integral part of the Sales Agreements concluded by the Seller with the Customers.
  2. The Seller reserves the right to amend the Terms and Conditions at any time. Amendments to the Terms and Conditions are effective from the moment they are published on the Online Store website. Amendments to the Terms and Conditions may not violate the acquired rights of Customers using the Online Store.
  3. The Seller reserves the right to change the prices and quantities of goods available in the Online Store, withdraw or introduce new goods for sale, conduct and cancel promotional campaigns, as well as modify them on the Online Store website, or introduce changes therein in accordance with the provisions of the Civil Code and other acts, provided that such changes do not violate the rights of persons who concluded sales agreements for goods offered by the Online Store before the aforementioned changes were made.
  4. The Seller takes steps to ensure the proper functioning of the Online Store, to the extent that results from current technical knowledge, and undertakes to remove any irregularities reported by users within a reasonable time.
  5. In matters not regulated by these Regulations, the provisions of the Civil Code or other acts applicable to the activity and functioning of the Online Store in force in the territory of the Republic of Poland shall apply accordingly.
  6. The court having jurisdiction to resolve disputes is the Common Court with local jurisdiction in accordance with applicable regulations.
